澳大利亚总理正式宣布,457签证将被取消

On 18 April 2017, the Government announced that the Temporary Work (Skilled) visa (subclass 457 visa) will be abolished and replaced with the completely new Temporary Skill Shortage (TSS) visa in March 2018.

移民局将于2018年3月废除现有的457雇主担保签证,新的临时技能短缺签证(TSS)将取而代之。

The TSS visa programme will be comprised of a Short-Term stream of up to two years and a Medium-Term stream of up to four years and will support businesses in addressing genuine skill shortages in their workforce and will contain a number of safeguards which prioritise Australian workers.

新的TSS 签证将分为两个类别,2年短期签证和4年中期签证

This new visa is part of the Government’s significant reform package to strengthen the integrity and quality of Australia’s temporary and permanent employer sponsored skilled migration programmes.

Key reforms include:

新签证的改革要点:

·        Introducing the temporary skill shortage visa with new requirements, including but not limited to:

引进新的临时仅能短缺签证并更新申请要求

o   new, more targeted occupation lists which better align with skill needs in the Australian labour market

更紧缩的职业紧缺列表

o   a requirement for visa applicants to have at least two years’ work experience in their skilled occupation

签证申请者至少要有2年相关工作经验

o   a minimum market salary rate which ensures that overseas workers cannot be engaged to undercut Australian workers

海外劳工的最低收入不能作为削减澳洲本地职工的因素

o   mandatory labour market testing, unless an international obligation applies,

强制执行劳工市场测试

o   capacity for only one onshore visa renewal under the Short-Term stream

仅提供一次境内续签2年短期签证的机会

o   capacity for visa renewal onshore and a permanent residence pathway after three years under the Medium-Term stream

4年中期签证下满3年可申请永居签证,仅提供过一次签证续签机会。

o   the permanent residence eligibility period will be extended from two to three years

永居的申请资格有之前的2年延长为3年

o   a non-discriminatory workforce test to ensure employers are not actively discriminating against Australian workers

通过无种族歧视劳动力测试

o   strengthened requirement for employers to contribute to training Australian workers

对雇主培训员工的要求更严格

o   the Department of Immigration and Border Protection will collect Tax File Numbers and data will be matched with the Australian Tax Office’s records, and

移民局将会要求申请者提供税号和交税信息,这些信息将会与税务局进行匹配

o   mandatory penal clearance certificates to be provided.

·        Tightening eligibility requirements for employer sponsored permanent skilled visas, including but not limited to:

o   tightened English language requirements

更严格的语言要求

o   a requirement for visa applicants to have at least three years’ work experience

申请者需要有至少3年的相关工作经验

o   applicants must be under the maximum age requirement of 45 at the time of application

申请者年龄不得超过45岁

o   strengthened requirement for employers to contribute to training Australian workers, and

对雇主培训员工的要求更严格

o   employers must pay the Australian market salary rate and meet the Temporary Skilled Migration Income Threshold1.

雇主必须付澳洲最低工资标准, 目前是$53900

·        Concessions for regional Australia will continue to be available:

依然保留对于偏远地区的优惠

o   Employers in regional Australia will continue to have access to occupations under the temporary and permanent visas, to reflect their skills needs.

偏远地区的雇主依然可以通过临时和永居签证来满足对技能员工的需求

o   Existing permanent visa concessions for regional Australia, such as waiving the nomination fee and providing age exemptions for certain occupations, will be retained. Consideration will be given to expanding the occupations in regional Australia that are exempt from the age requirement.

现有的对于偏远地区雇主的优惠政策,如免除提名申请费和对于特殊职业免除年龄要求将保持。对偏远地区的特定职业将会给予一定的考虑来免除年龄要求。

·        Significantly condensing the occupation lists used for skilled migration visas, including the subclass 457 visa, from 19 April 2017.

对于紧缺职业列表,包括457签证的职业列表,将从19/04/2017有重要的紧缩及变化。

The implementation of these reforms will begin immediately and will be completed in March 2018.

这个改革将在2018年3月开始实行。
